                                                              PENAL CODE SECTION 653.1

(a) No person shall sell or distribute any balloon that is constructed of electrically conductive material, and filled with a gas lighter than air without;

(1)Affixing an object of sufficient weight to the balloon or its appurtenance to counter the lift capability of the balloon.

(2)Affixing a statement on the balloon, or ensuring that a statement is so affixed, that warns the consumer about the risk if the balloon comes in contact with electrical power lines.

(3)A printed identification of the manufacturer of the balloon.

(b) No person shall sell or distribute and balloon filled with a gas lighter than air that is attached to an electrically conductive string, tether, streamer, or other electrically conductive appurtenance.

(c)
No person shall sell or distribute any balloon that is constructed of electrically conductive material and filled with a gas lighter than air and that is attached to another balloon constructed of electrically conductive material and filled with a gas lighter than air.

(d)
No person or group shall release, outdoors, balloons made of electrically conductive material and filled with a gas lighter than air, as part of a public or civic event, promotional activity, or product advertisement.

(e)
Any person who violates subdivision (a), (b), (c) , or (d) shall be guilty of an infraction punishable by a fine not exceeding one hundred dollars ($100.00). Any person who violates subdivision (a), (b), (c), or (d) who has been previously convicted twice of violating subdivision (a), (b), (c), or (d) shall be guilty of a misdemeanor.

(f)
This section shall not apply to manned hot air balloons, or to balloons used in governmental or scientific research projects.

Note:
California Balloon Law is not used in all states, but it's best followed everywhere, so foil balloons will not be banned in any state!



FAQ's


Are balloons safe for small kids?

Balloons are not intended for children under 3 years old. Balloons that have not been inflated or burst can cause suffocation if swallowed
.

Never attach balloons to a crib or a child's bed. Balloons with ribbons can cause strangulation of children under 3 years old.

How much does balloon decor cost?
Our balloons come in a wide variety of shapes, sizes and colors. We specialize in classic decor to include arches, columns, bouquets and custom sculptures. What is Helium?
Helium is environmentally safe, non-toxic and not flammable. Helium should not be inhaled, as it displaces the oxygen in your lungs, causing serious lung injuries.  Helium can be absorbed into the blood stream or cause asphyxiation it also causes headaches. Do not inhale helium from a balloon or a helium tank under any circumstances.


Are latex balloons bio-degradable?
Yes! Latex balloons are made from bio-degradable rubber tree sap and are environmentally safe. Latex balloons bio-degrade at the same rate as an oak leaf. Latex
balloons that fly away rise into the upper atmosphere where they shatter and no, sea mammals are not at risk from balloons.

How long will my balloons float?
That depends on the size of the balloon. The larger the balloon, the more helium used, therefore the longer the balloon will last. Foil balloons last longer than latex balloons. We also use a special treatment allowing latex balloons to last 5 times longer then without treatment. Also, most of work that is air filled lasts up to one month or longer, depending on the environment.  Outside decor deteriorates faster due to weather elements.

Why should I be careful with Metallic balloons outside?
Helium filled foil balloons can be dangerous if they become tangled in power lines. Loose balloons, especially metallic/foil/mylar balloons, can cause power outages and may cause wires to fall to the ground resulting in property damage, fire, and even injury or death. Avoid potential balloon hazards by following these tips.
NEVER let helium balloons drift away outdoors.
NEVER try to retrieve balloons caught in a power line. And NEVER go near a downed power line or dangling wire.
